De Haij & Van der Wende Lawyers is a partnership (which
includes professional corporations) established in Capelle a/d IJssel,
the Netherlands.
All instructions from clients are solely
accepted and carried out by De Haij & Van der Wende Lawyers. The
provisions of articles 7:404 and 7:407 paragraph 2 of the Dutch Civil
Code are hereby excluded.
Any and all liability of De Haij
& Van der Wende Lawyers is limited to the amount paid out under De
Haij & Van der Wende Lawyers’ professional liability insurance
policy in the matter concerned. Information about the (cover under the)
professional liability insurance entered into by De Haij & Van der
Wende Lawyers shall be supplied upon request.
De Haij &
Van der Wende Lawyers shall, as far as possible, consult the client
before engaging third parties, and shall in any event exercise the
necessary due care in its selection of third parties. De Haij & Van
der Wende Lawyers is not liable for any acts and/or omissions of third
parties and is authorised to accept any possible limitations to its
liability with regard to the third parties that it has involved without
prior consultation with the client or on behalf of the client.
The
client shall allow that De Haij & Van der Wende Lawyers and the
persons involved in carrying out an assignment by or on behalf of De
Haij & Van der Wende Lawyers share information relating to the
client and an assignment awarded by the client with other persons
connected with De Haij & Van der Wende Lawyers, to the extent
required or useful for the purposes of client relation management.
The
legal relationship between De Haij & Van der Wende Lawyers and the
client, as well as between De Haij & Van der Wende Lawyers and
those that make use of De Haij & Van der Wende Lawyers’ services,
shall be subject to Dutch law. All disputes shall be exclusively
decided by the competent court in Rotterdam, the Netherlands.
Any
rights of action and other rights against De Haij & Van der Wende
Lawyers in connection to the services rendered by De Haij & Van der
Wende Lawyers shall expire at any rate one year after the date on which
the party became aware or could reasonably have become aware of the
existence of those rights.
All stipulations in the
present general conditions are stipulated for the benefit of not only
the partners of De Haij & Van der Wende Lawyers, but also the
managing directors of professional corporations and those who work or
worked for the partnership.
These general conditions have
been drawn up in Dutch and English. In the event of disputes concerning
the interpretation of these general conditions, the Dutch text will
take precedence.
