Arbitration

In construction and contracting agreements, there is often a clause stating that all disputes arising between the parties will be resolved through arbitration. These disputes can then be submitted to the Council for Arbitration in Construction Disputes (RvA). The possibility of arbitration is enshrined in law and is a form of adjudication that is particularly suitable for resolving issues relatively quickly, adequately, and, above all, practically. The arbitrators of the RvA assess the case in accordance with statutory rules. Their decision, therefore, has the same legal force as a judgment by a court. The advantage of arbitration with the RvA is that the arbitrators often also have specific technical expertise, which is especially crucial in construction matters. Since judgments must be made within the legal framework, legal assistance in arbitration cases is at least as important and, in practice, certainly necessary.
