The Inspectorate SZW monitors whether employers and employees comply with the various laws, decrees, and regulations in the field of labor. This includes, for example, the Minimum Wage and Minimum Holiday Allowance Act and the Working Hours Act.
If the rules are violated, the Inspectorate SZW can take enforcement action. The Inspectorate uses a mix of instruments such as warnings, fines, and shutdowns.
How likely is it that the Inspectorate will visit your company? Companies that are expected to comply with legislation better than their counterparts in other sectors are less likely to be inspected. However, employees can also file an (anonymous) report or request with the Inspectorate. Additionally, CAO parties can report non-compliance with CAO provisions and request supportive research by the Inspectorate SZW.
It is important that you respond quickly and adequately to information requests from the Inspectorate SZW, as a very strict enforcement policy is applied. De Haij & Van der Wende lawyers can guide you during an investigation by the Inspectorate SZW and answer any questions from the Inspectorate on your behalf. We also have experience in objection and appeal procedures to contest any fines.
